Terms Of Service

The Basics
 

-The Client must be 18 years or older to purchase any material from The Artist.
 
-The Client u
nderstands that The Artist has the right to cancel the commission at any time, and a refund will be issued in accordance with the Refund Policy below.
 
-Any falsified information (Age, Name, Permission to character, ownership, ETC.) will lead to termination of the commission.
 
-Payment must be made in full once the detailed sketch has been accepted by client.

1. Payment Policy
 
I accept payment through Paypal Invoice only. Payment must be made in USD
 
• While an invoice may be sent as soon as the commission has been accepted, the client has the right to pay the invoice at any point up until the detailed sketch has been accepted.
 
• Upon next communication with artist (whether an update or verification) the artist will verify that payment has been processed.
 • Payment plans may be offered but must be discussed before commission has begun.
 • NFT and Cryptocurrencies are not permitted as forms of payment.

 


2. Character Permission
 
As of May 1st, 2021 The Artist will no longer accept commissions with characters not owned by The Client without express consent, for the image to be created, by the owner(s).
 
This character use consent can be given two ways:
• Have The Owner of the character(s) message me personally allowing you permission for this commission.
• Or send me a full screen shot with The Owner’s username, The Client’s username, time, and date all clearly visible. The Owner must mention what rating has been permitted (sfw/nsfw).
 
In the event of the commission being a gift/surprise please message The Artist before hand. If The Artist is concerned at all that The Client does not have proper permission to use the character in question, The Artist will terminate the commission and The Client may be banned from ordering again in the future.
 


3. Refund Policy
 
A refund may be issued if it falls under the following circumstances. Refunds are not limited to the following circumstances as such the following should be used as a point of reference. For refunds regarding the Harassment/abuse terminations Policy please refer to section 9. If a refund has been issued The Client gives up all right to any completed art of the commission.
 
• Full refund: if The Client must cancel commission and no work beyond a simple sketch has been completed by The Artist.
 • Half refund: if a detailed sketch has been completed but before the line work has yet to be completed and accepted.
 
No refund will be issued if:
 
• Artist has completed the commission. Or reached the color stage(s) of commissions. Any commission that does not need coloring still falls under this refund policy.
• If commission is finished, and was accepted then the client returns saying they are unhappy at a later time. If the client is unclear on where a refund falls, please contact The Artist.
 


4. Additional Fees
 
Additional fees can apply to any commission, these are not limited to what is below and as such should be used as a reference point. The artist will inform the client if an additional fee may apply to their works. These are separate from add on fee's that are displayed with prices.
 
•Additional fees may apply if client asks for more then two edits on a certain detail of the image.
 •Additional fees may apply if client asks for edits to the line work after line work has been accepted.
 •Additional fees may apply if client requests last stage edits.
 •Additional fee may apply if client requests changes once the commission has been reviewed and finalized.
 


5. Streaming
 
The Artist may stream commissions, these are no longer a requestable item.
 
• Commissions taken in stream are assumed to have permission to be streamed. • No Commission labeled as a 'gift' or 'anonymous' will be used for streaming.
 
 

6. Deadlines and Trello
 
While The Artist does not officially accept deadlines for most commissions. Special offers may be accepted. All pieces with deadlines must be discussed before submission is accepted and with at least two weeks prior to due date. However, this does not give priority over other works in The Artist’s queue.
 
The Artist’s queue has now been relocated to Trello for updated ease of access and editing. The Artist works primarily in order of the list, with at least five currently active commissions ongoing, in difference stages. There is no fee or boost one can purchase to be pushed ahead in this list. Where you are reflects progress on the commission.
 


7. Art Permission, Credit, And Posting
 
Upon finished work being delivered to the client, the client will be given a full high res image of product (and a smaller posting version when requested). All clients have the right to post artwork in any gallery, or image hosting website of their choosing. The Artist requires credit and/or a link back to one of The Artist’s main galleries. If a link cannot be given. A water marked version can be provided.
 
The Client retains the rights of personal use. This includes but is not limited to the right to crop, and/or use any finished commission for personal banners/icons. Artwork may also be used as further reference for characters if required.
 
The Client does not have the right to edit the artwork, in any terms not listed above. This includes but is not limited to recoloring, rehashing or removing anything that may be outdated. Also includes re-creating a new character, having another artist draw over or changing colors.
 
The Client does not hold any rights to make profit from the artist's works, without a written and signed commercial contract. If profit has been or is being made from The Artist's work. Legal action may be taken.
 
 
 
8. A.I Usage, Programming, and References
 
The Artist does not give any Client or Third-Party member permission to use art made by The Artist in A.I programming or anything associated with A.I.

The Artist will also not work with any images generated through A.I. Not as references, adopts, ETC. Any use of generated images while working with the artist will end in cancellation of the work and a ban from further working with the artist.



9. Harassment Policy

Any verbal and/or written forms of harassment or abuse towards the ARTIST by the CLIENT or violation of the following Terms of Service will result in immediate termination of the commission and a ban on future commissions. Harassment and/or abuse includes but is not limited to:

• Stalking
• Threats to the ARTIST’s or anyone else's personal safety
• Threats of self harm on the CLIENT's part as leverage (for any reason)
• Threats of cancellation on the CLIENT's part as leverage (for any reason)
• Threats of Charge Back
• Begging and pleading after a commission has been denied
• Derogatory Language
• The attempted justification of derogatory language
• Incessant or Obsessive Me
ssaging
• Demanding of private and/or personal information
• Messaging on all media's forms in a repetitive/harassing manner

If the Harassment Policy is violated, a refund may be granted depending on the status of the CLIENT's commission. The rules for refunds regarding the status of a commission are mentioned previously in section 3.
